OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• (a) Implied warranties of merchantability and fitness for a particular purpose
• (b) Warranties regarding the accuracy, reliability, or completeness of information
• (c) Warranties that our services will be uninterrupted, secure, or error-free
• (d) Warranties regarding the quality, characteristics, or availability of coffee products
• (e) Any warranties arising from course of dealing or usage of trade

3.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOLAVEN QUIET SHALL NOT BE LIABLE FOR:

• (a) Any indirect, incidental, special, consequential, or punitive damages
• (b) Loss of profits, revenues, data, or use
• (c) Business interruption or loss of business opportunities
• (d) Damages arising from agricultural variations, crop failures, or quality fluctuations
• (e) Delays, disruptions, or failures in coffee production, processing, or shipping
• (f) Actions or omissions of third-party producers, exporters, or service providers

Our total liability to you for any claims arising from these terms or our services shall not exceed the fees you paid to us in the twelve months preceding the claim.

3.3 Agricultural and Quality Disclaimers

Coffee is an agricultural product subject to natural variation. We do not guarantee specific quality scores, flavor profiles, processing outcomes, or yield quantities. Weather conditions, pest pressures, soil variations, and processing methods can affect coffee characteristics. While we strive to facilitate quality sourcing, final coffee quality is subject to factors beyond our reasonable control.

3.4 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, government actions, pandemics, transportation disruptions, agricultural failures, or failures of third-party service providers.

4.1 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Laos, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Champasak Province, Laos, for the resolution of any disputes arising from these terms or your use of our services.

4.2 Dispute Resolution Procedures

In the event of any dispute, controversy, or claim arising from these Terms and Conditions:

• (a) The parties agree to first attempt resolution through good-faith negotiations
• (b) If negotiations fail within 30 days, either party may pursue mediation
• (c) Mediation shall be conducted by a mutually agreed-upon mediator
• (d) If mediation is unsuccessful, disputes may be submitted to binding arbitration or court proceedings
• (e) Each party shall bear its own costs for dispute resolution unless otherwise agreed

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.
